I. General information
The confidentiality of your personal data is one of the main concerns of Tidyful.ro, based in Romania, as the data controller.
This document aims to inform you about the processing of your personal data in the context of using the Tidyful.ro website ("the Site").

II. Categories of personal data processed

II.1. If you are a customer of the Site, Tidyful.ro will process your personal data such as name, phone number, email address, billing address, delivery address, data regarding your use of the Site, such as your behavior/preferences/habits on the site, as well as any other categories of data you provide directly in the context of creating a user account, placing an order through the Site or in any other way resulting from the use of the Site.

If you use your Facebook or Google account to create a user account on the Site, Tidyful.ro will process the following public profile data displayed by the respective applications: username, email address.

If you choose to create a user account only before completing the order of a product available on the Site, your email address will be requested, based on which an account will be automatically created. If you do not complete the order, the email address and other provided data will not be stored by Tidyful.ro, and the created account will be automatically deleted.

II.2. If you are a visitor of the Site, Tidyful.ro will process your personal data that you provide directly in the context of using the Site, such as the data you provide in the contact/questions/reservations section, to the extent that you contact us in this way.

II. Purposes and grounds for data processing

III.1. If you are a customer of the Site, Tidyful.ro processes your personal data as follows:

• for the performance of the contractual relationship between you and Tidyful.ro, namely for taking, validating, dispatching and invoicing the order placed on the Site, informing you about the status of the order, organizing the return of ordered products, etc. Grounds: The processing of your data for this purpose is based on the contract concluded between you and Tidyful.ro, as defined in the Terms and Conditions. Providing your personal data is necessary for the performance of this contract. Refusal to provide data may result in the inability to carry out contractual relations between you and Tidyful.ro.

• for fulfilling legal obligations that Tidyful.ro is required to comply with in the context of the services provided through the Site, including tax obligations, as well as archiving obligations. Grounds: The processing of your data for this purpose is necessary based on legal obligations. Providing your data for this purpose is necessary. Refusal to provide data may result in Tidyful.ro being unable to comply with its legal obligations and therefore unable to offer you services through the Site.

• for marketing activities, namely for transmitting commercial communications regarding the products and services offered by Tidyful.ro through the Site, via distance communication means (email, SMS).
  
  Grounds: The processing of your data for this purpose is based on your consent, if you choose to provide it.
  
  You can express your consent for the processing of data for this purpose by checking the corresponding box at the time of creating your account, or later, in the section My Account Information. To unsubscribe from receiving such commercial communications, you can use the option at the end of each email/SMS containing commercial communications. In addition, you can unsubscribe by accessing the My Account Information section. Providing your data for this purpose is voluntary. Refusal to provide consent for the processing of your data for this purpose will not have negative consequences for you regarding the access to services and products on the Tidyful.ro site.

• for various analyses, reports on the functioning of the Site, profiling of consumer preferences, mainly to improve the experience offered on the Site. Grounds: The processing of your data for this purpose is based on Tidyful.ro's legitimate interest in continuously improving the customer experience on the Site. Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will not have negative consequences for you regarding the access to services and products on the Tidyful.ro site.

III.2. If you are a visitor to the website, Tidyful.ro processes your personal data as follows:
 

•  for marketing activities, specifically for sending commercial communications via distance communication means (email, SMS) about products and services offered by Tidyful.ro through the website.

 

• for handling complaints, claims, and monitoring traffic to improve your experience on the website.

Basis: The processing of your data for these purposes is based on the legitimate interest of Tidyful.ro to ensure the correct functioning of the website and to continuously improve the experience of website visitors, including resolving comments, questions, or complaints. Providing your data for these purposes is voluntary. Refusing to provide your data for these purposes will not have any negative consequences for you.
 

IV. Duration for which we process your data

As a general principle, Tidyful.ro will process your personal data only for as long as is necessary to achieve the processing purposes mentioned above.

If you are a customer, we will process your data for the entire duration of the contractual relationship and subsequently in accordance with the legal obligations that fall under Tidyful.ro's responsibility (e.g. for financial-accounting documents, the legal retention period is 10 years from the end of the financial year in which they were drawn up).

In case you are a customer and you exercise the option to delete your user account, we would like to inform you that deleting the account will not automatically result in the deletion of your personal data. If you no longer want your personal data to be processed or if you want your data to be deleted, you can exercise your rights detailed in point VII below. If you request the deletion of your account but there is at least one active order on that account, the account deletion request will only be recorded after the products are delivered and the last active order is completed.

If you withdraw your consent for the processing of data for marketing purposes, Tidyful.ro will cease processing your personal data for this purpose, without affecting the processing carried out by Tidyful.ro based on your consent before its withdrawal.

V. Disclosure of personal data

In order to achieve the processing purposes, Tidyful.ro may disclose your data to partners, third parties, or entities that support Tidyful.ro in carrying out its activities through the Site (e.g. courier companies), or to central/local public authorities, in the following exemplarily enumerated cases:

   for the administration of the Site;
   in cases where this communication is necessary for the awarding of prizes or other benefits obtained by the data subjects as a result of their participation in various promotional campaigns organized by Tidyful.ro through the Site;
   for the maintenance, customization, and improvement of the Site and the services carried out through it;
   for data analysis, testing and research, monitoring usage trends and activity, developing safety features and user authentication;
   for the transmission of marketing communications, within the conditions and limits provided by law;
   when the disclosure of personal data is provided by law, etc.
 

VI. Transfer of personal data

Personal data provided to Tidyful.ro may be transferred outside of Romania, but only to states within the European Union.

VII. Rights you have

Under the conditions provided by the legislation on the processing of personal data, as data subjects, you have the following rights:
The right to information, namely the right to receive details regarding the processing activities carried out by Tidyful.ro, in accordance with those described in this document;

The right of access to data, namely the right to obtain confirmation from Tidyful.ro regarding the processing of personal data, as well as details regarding the processing activities such as the method in which data is processed, the purpose for which processing is carried out, the recipients or categories of recipients of the data, etc;

The right to rectification, namely the right to obtain the correction, without undue delay, by Tidyful.ro of inaccurate/ unjustified personal data, as well as the completion of incomplete data; The rectification/ completion will be communicated to each recipient to whom the data have been transmitted, except where this proves impossible or involves disproportionate effort.

The right to erasure of data, without undue delay, ("right to be forgotten"), if one of the following reasons applies:

   they are no longer necessary for the purposes for which they were collected or processed;
   in case the consent is withdrawn and there is no other legal ground for processing;
   in case the data subject objects to the processing and there are no overriding legitimate grounds for the processing;
   the personal data have been processed unlawfully;
   the personal data must be erased for compliance with a legal obligation;
   the personal data have been collected in relation to the offer of information society services as provided for by Union law or the law of the Member State under which the controller is subject.

It is possible that, following the request for data deletion, Tidyful.ro will anonymize this data (thus depriving them of their personal character) and continue processing them for statistical purposes; the right to restrict processing to the extent that:

    the person contests the accuracy of the data, for a period allowing Tidyful.ro to verify the correctness of the data;
    the processing is illegal, and the data subject opposes the erasure of personal data and requests instead the restriction of their use;
    the data controller no longer needs the personal data for processing purposes, but the data subject requires them for the establishment, exercise or defence of legal claims; or
    the data subject has objected to processing (other than for direct marketing) during the period while it is verified whether the legitimate grounds of the controller override those of the data subject.

the right to data portability, meaning (i) the right to receive personal data in a structured, commonly used and machine-readable format, and (ii) the right to have this data transmitted by Tidyful.ro to another data controller, to the extent that the conditions provided by law are met;

Right to object - regarding processing activities, it can be exercised by submitting a request in accordance with the indications below;

at any time, for reasons related to the particular situation in which the data subject finds themselves, that the data concerning them be processed on the basis of the legitimate interest of Tidyful.ro or on the basis of public interest, except where Tidyful.ro can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims;

at any time, free of charge and without any justification, that the data concerning them be processed for direct marketing purposes.

the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;

the right to address the National Supervisory Authority for Personal Data Processing or the competent courts, as necessary.
